Terms & Conditions

1. Image Usage – Personal Use Licence

Clients are granted a personal, non-commercial licence to use the images provided for:

  • Sharing with family and friends

  • Display on personal social media accounts (with credit appreciated)

  • Printing for personal use

Images may not be used for commercial, editorial, resale, or promotional purposes without prior written permission.

2. Copyright and Intellectual Property

All photographs taken by Louise Murnane Photography are protected under UK Copyright Law (Copyright, Designs and Patents Act 1988). Copyright remains the sole property of the photographer, Louise Murnane.

Upon full and final payment, you are granted a limited licence for personal use only, as outlined in Section 1.

You may not:

  • Edit, alter, or apply filters to the images without permission

  • Sell, license, or distribute the images

  • Submit the images to competitions or publications without written consent

Any unauthorised use constitutes a breach of this agreement and may lead to legal action.

3. Model Release

By booking a session, the Client and any individuals photographed grant Louise Murnane Photography the right to use and publish images for:

  • Portfolio and website display

  • Social media promotion

  • Advertising, marketing, and promotional materials

  • Editorial or trade purposes

No names or personal information will be used without your prior consent. Images will not be sold or shared with third parties under any circumstances.

Opt-Out:

You may opt out of the model release by emailing: info@louisemurnanephotography.co.uk at any time before or after the session.

4. Service Agreement

Louise Murnane Photography agrees to provide photography services with reasonable skill and care, in accordance with the package selected. Artistic interpretation and style are at the discretion of the photographer and are considered final.

Due to the subjective nature of photography, no specific outcome is guaranteed, and all sales are final.

5. Complaints

If you are dissatisfied with any aspect of the service or product received, please submit your complaint in writing within 7 days of receiving the final images or products (e.g. albums or frames).

Complaints received after this period may not be accepted.

6. Booking Fee and Payment Terms & Cancellations:

  • A non-refundable booking fee is required to secure your session.

  • This fee is deducted from the total cost of your selected package.

  • The remaining balance is due as agreed prior to the session.

 

  • Booking fees are non-refundable under all circumstances.

  • If the client cancels, any materials or expenses already incurred must be paid in full.

  • If the photographer cancels, a full refund of all monies paid will be issued.

7. Illness & Rescheduling

If you or anyone attending your session becomes unwell (e.g. has a temperature, cough, or contagious illness), please inform us as soon as possible.

  • A minimum of 24 hours' notice is required for illness-related cancellations or rescheduling requests.

  • While the booking fee remains non-refundable, we will do our best to reschedule your session to a mutually convenient date, subject to availability.

  • Cancellations made with less than 24 hours' notice may result in the loss of your booking fee and session slot, and a new booking may be required.

Louise Murnane Photography is not liable for cancellations due to illness or other unforeseen circumstances on the part of the client.

8. Health, Safety & Client Responsibility

Louise Murnane Photography conducts sessions in a variety of locations including private homes, hired venues, and outdoor public spaces. By attending a session, you acknowledge and accept the following:

  • You are responsible for the safety and supervision of any children or dependents attending the session.

  • Louise Murnane Photography is not liable for any injury, damage, or loss sustained by any person or property during the session, whether indoors or outdoors, at a private or public location.

  • Certain equipment used during sessions (e.g. lighting or heaters) may pose a risk if touched. Please ensure children and vulnerable individuals are supervised at all times.

Clients agree to take all reasonable precautions to ensure their own safety and the safety of others attending with them.

9. Online Galleries & Image Storage

Edited images from your session will be delivered via a secure online gallery. Please note the following:

  • Galleries are available for a period of 3 months (90 days) from the date of delivery.

  • After this time, the gallery will automatically expire and access to the images will be removed.

  • Clients are responsible for downloading and safely backing up their images within this time frame.

Louise Murnane Photography cannot guarantee storage or retrieval of images after the gallery has expired, and may not be able to resend files once the access period has ended.

It is the client’s responsibility to ensure all images are backed up and stored securely once delivered.

10. RAW Files & Final Image Delivery

Louise Murnane Photography provides clients with professionally edited, high-resolution final images only.

  • RAW (unedited) files are not available for viewing, download, or purchase under any circumstances.

  • All delivered images represent the photographer’s final artistic vision and are fully edited in line with the style of Louise Murnane Photography.

  • RAW files are permanently deleted once the final gallery is delivered.

Requests for alternative edits, file types, or access to unedited images will not be accommodated. This ensures consistency in quality and protects the creative integrity of the work.

11. Governing Law

This agreement is governed by and shall be construed in accordance with the laws of England and Wales.Both parties submit to the exclusive jurisdiction of the English courts.

12. Acceptance of Terms

By booking a session and/or paying the booking fee, you confirm that:

  • You have read, understood, and agreed to these Terms & Conditions

  • You are entering this agreement on behalf of yourself and all persons attending the session
